HC ADJOURNS HEARING ON OBJECTION TO ADV SARESH LOTLIKAR APPEARING AGAINST ACB

PANJIM: Justice P.V Hardas the vacation Judge of the Bombay High Court at Goa today adjourned to October 28th hearing on the intervention application moved by Adv. Aires Rodrigues objecting to Senior Advocate Saresh Lotlikar appearing in an anticipatory bail application against the Anti-Corruption Branch (ACB). When the anticipatory bail application filed by former Sancoale Sarpanch Ramakant Borkar came up for hearing today Justice Hardas adjourned the matter stating that the intervention application filed by Adv. Aires Rodrigues had to be decided first.
Pointing out to the Court that Saresh Lotlikar has been appointed as Special Public Prosecutor in various criminal matters of the Goa Police, including matters investigated by the ACB, Adv. Aires Rodrigues has in his application submitted that interest of justice and professional ethics demands and mandates that Saresh Lotlikar should not be appearing in matters against the ACB.
Adv. Rodrigues has further submitted that there is an impression in the minds of most accused that Saresh Lotlikar having appeared for the ACB as a Special Public Prosecutor is in a better position to get them reliefs on account of his influential position with the investigating officers which Saresh Lotlikar has developed during the course of his appointments as Special Public Prosecutor.
Adv. Rodrigues in his application has also sought that this gross misconduct by Saresh Lotlikar be referred by the High Court to the Bar Council of India for prompt and deterrent action including disrobing Saresh Lotlikar of his status as a Senior Advocate.
